1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Flee ("Company," "we," "us," or "our") concerning your access to and use of the Flee mobile application and related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with these Terms, you must not access or use the Service.

2. Eligibility

You must be at least 13 years of age (or the applicable age of consent in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

If you are under 18 years of age, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Account Registration and Security

3.1 Account Creation

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access or security breach

3.2 Account Responsibility

You are responsible for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to maintain account security.

4. Acceptable Use

4.1 License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use.

4.2 Prohibited Conduct

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Violate any applicable laws, regulations, or third-party rights
• Harass, abuse, threaten, or harm other users
• Impersonate any person or entity or misrepresent your affiliation
• Interfere with or disrupt the Service or servers/networks connected to the Service
• Attempt to gain unauthorized access to any portion of the Service
• Upload or transmit viruses, malware, or other malicious code
• Collect or harvest information about other users without consent
• Use automated systems (bots, scrapers) to access the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Remove or modify any copyright, trademark, or proprietary notices
• Share content that is inappropriate, offensive, or harmful

5. User Content

5.1 Your Content

You may be able to submit, post, or share content through the Service ("User Content"). You retain ownership of your User Content, but you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your User Content in connection with operating and providing the Service.

5.2 Content Standards

You represent and warrant that your User Content:

• Does not violate any intellectual property or other rights of any third party
• Does not contain unlawful, harmful, or offensive material
• Does not contain sensitive personal information about others without consent
• Complies with all applicable laws and regulations

5.3 Content Moderation

We reserve the right to review, monitor, and remove User Content that violates these Terms or is otherwise objectionable, at our sole discretion.

6. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Flee and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used without our prior written permission.

7. Third-Party Services

The Service may contain links to third-party websites, services, or resources. We are not responsible for the content, privacy policies, or practices of any third-party services. Your use of third-party services is at your own risk.

8. Subscription and Payments

8.1 Fees

Certain features of the Service may require payment of fees. All fees are in U.S. dollars unless otherwise stated. We reserve the right to change our fees at any time with prior notice.

8.2 Billing

By providing payment information, you authorize us to charge your payment method for all fees incurred. You are responsible for all charges, including applicable taxes.

8.3 Refunds

All fees are non-refundable unless otherwise required by law or stated in these Terms.

9.1 Service Availability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

9.2 Not Professional Advice

THE SERVICE IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL, PSYCHOLOGICAL, OR COUNSELING SERVICES. THE CONTENT AND FEATURES PROVIDED THROUGH THE SERVICE ARE FOR INFORMATIONAL AND SUPPORT PURPOSES ONLY. IF YOU ARE EXPERIENCING A CRISIS OR EMERGENCY, PLEASE CONTACT EMERGENCY SERVICES OR A QUALIFIED HEALTHCARE PROFESSIONAL IMMEDIATELY.

9.3 User Interactions

We are not responsible for the conduct of other users or the content they share. Interactions with other users, including accountability partners, are at your own risk.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLEE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

11. Indemnification

You agree to indemnify, defend, and hold harmless Flee and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

• Your access to or use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your User Content

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

You may terminate your account at any time by contacting us or using the account deletion feature in the Service.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

13.2 Dispute Resolution

Any dispute arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive your right to a jury trial and to participate in a class action lawsuit.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Service and updating the "Last updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Flee regarding the Service and supersede all prior agreements and understandings.

18. SMS Messaging Terms

18.1 Program Description

Program Name: Flee Partner Alerts (the "SMS Program")

Description: The SMS Program enables accountability partnerships within the Flee app. When you invite an accountability partner, they receive SMS alerts when you request support, change app blocking settings, or need encouragement during your recovery journey. This is a notification service, not a marketing program.

18.2 Opt-In Consent

By replying "YES" to the accountability partner invitation message, you consent to receive SMS notifications from Flee for the purposes described above. Your partner must also consent by replying "YES" to receive alerts about your activity.

18.3 Message Frequency

Message frequency varies based on user activity. You may receive approximately 0-5 messages per month, up to a maximum of 10 messages per month. Frequency depends on how often your accountability partner requests support or updates their settings.

18.4 Costs

Message and data rates may apply. Flee does not charge for SMS messages, but your mobile carrier may charge standard messaging rates according to your phone plan.

18.5 Opt-Out

You can opt-out at any time by replying STOP to any message from Flee. You will receive a confirmation message, and no further messages will be sent to your phone number. We honor opt-out requests immediately.

18.7 Eligibility

The SMS Program is available to users with U.S. phone numbers only. This is not a marketing service—we only send transactional notifications related to your accountability partnerships.

18.8 SMS Service Provider

We use Twilio and other service providers to deliver SMS messages. We will never share your phone number with third parties for marketing purposes.

18.9 Changes to SMS Terms

We may update these SMS Terms from time to time. Continued use of the SMS Program after changes are posted constitutes acceptance of the updated terms.
